In Alabama,Is it legal to cut employee's hours just so they will lose insurance/other benefits?
My husband works at a small branch of a bigger company. They gave him and one other person the choice to either quit and go through a temporary agency to work 40 hours (for less pay) or stay at the company and work 31 hours (part time). Because he is no longer considered full-time, he lost all the sick hours he had built up and lost insurance coverage. This company now only has two full time employees. My husband is the one part time employee. All other workers were hired through a temporary agency and given 40 hours a week with no benefits through this company because they are considered employees of the temp agency, not the company. My husband was working at this company at least 3 years before any of the temporary workers were hired. Is this legal??
